Technical Disclosure

Pursuant to the ePrivacy Directive (2002/58/EC) and GDPR Recital 47, Click41 employs advanced browser fingerprinting techniques to ensure platform integrity. Unlike cookies, which are stored on your device, this fingerprint is computed remotely based on your device's unique configuration.

The "Fingerprint" includes but is not limited to:

• Network Data: IP Address (v4/v6) and HTTP Headers (User-Agent, Accept-Language).
• Hardware Metrics: Screen resolution, color depth, and CPU concurrency.
• Rendering Entropy: HTML5 Canvas rendering offset data and WebGL vendor/renderer strings.

Legal Basis: Legitimate Interest

We process this data under GDPR Article 6(1)(f) (Legitimate Interests). This processing is strictly necessary for:

• Security: Preventing brute-force attacks, botnets, and denial-of-service (DoS) attempts.
• Fraud Prevention: Identifying duplicate accounts and enforcing bans on malicious actors.

A. Unilateral Right to Termination (Arbitrary Clause)

Access to Click41 services is a revocable privilege, not a right. The Platform Administrator reserves the absolute, unilateral, and arbitrary right to:

• Suspend, restrict, or permanently ban any user account or IP address.
• Delete any user-generated page or content.

Such actions may be taken at any time, without prior notice, and without providing a reason or justification. The User expressly waives any right to contest such termination or demand compensation for loss of data, audience, or revenue.

B. Payment Infrastructure & Billing

Click41 does not process, store, or handle financial data. All payments for page creation, maintenance, or premium features are processed exclusively by Stripe, Inc.

• Merchant of Record: Stripe is the sole Merchant of Record. Any billing disputes must be directed to the processor.
• No Refunds: All fees paid are non-refundable. In the event of an account ban (under Section A), any prepaid subscription time is forfeited as a penalty for breach of terms.

Neutral Service Provider Status

Click41 operates strictly as a "hosting service provider" under the definition of the EU Digital Services Act (DSA). We act as a passive conduit for user-generated information.

Total Liability Disclaimer

YOU AGREE TO HOLD HARMLESS AND INDEMNIFY Click41, its owners, and affiliates from any claims, damages, or legal actions arising from content you post. Click41 explicitly disclaims liability for:

• Illegal Entertainment: Pirated media, unauthorized streams, or illicit gaming promotion.
• Criminal Activity: Fraud, phishing, drug trafficking, or violent threats.
• Defamation & Hate Speech: Libel, slander, or incitement to violence against protected groups.
• Copyright Infringement: Unauthorized use of intellectual property.

Users are solely responsible for ensuring their content complies with the laws of their jurisdiction and the European Union.

Right to Access & Erasure (Art. 15 & 17 GDPR)

You may download a machine-readable format (JSON) of all data linked to your fingerprint, or permanently purge it. If you have changed networks, you may manually input a previous fingerprint hash to retrieve orphaned data.
